Terms and Conditions
1. Who we are
These terms apply to every quote, order and contract with Mistyprints, a sole proprietorship (eenmanszaak) at Gouden Leeuw 111, 1103 KA Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 42190041, VAT ID NL005568570B30, email info@mistyprints.com.
2. Business customers only
We sell only to businesses, such as coffeeshops, smoke shops and stores, and only to people aged 18 or older. By asking for a quote or placing an order, you confirm that you act for your business and that you are 18 or older. We do not sell to consumers.
3. What we sell
3D-printed storage cases and accessories, such as the Smokit, made to order and personalized with your logo, colors and finishes. The Smokit comes in a base version and in a version with a 5 ml glass jar included.
We do not sell tobacco, cannabis or any other smoking product. Our products are storage cases, and you are responsible for selling and using them in line with the law that applies to you.
Each item is printed on demand. Small differences in color, texture and visible print layers are normal and are not defects. Pictures on this website are renders of our 3D design and may differ slightly from the printed product. Before we produce a personalized order, we send you a design proof to approve.
4. Quotes and orders
- A quote is free and valid for 30 days unless it says otherwise.
- All prices exclude VAT unless stated otherwise. Delivery costs are shown in the quote.
- A contract starts when we confirm your order in writing (email is enough).
- Once you have approved the design proof and production has started, you cannot cancel the order. If you cancel before that, we refund what you paid minus the design work already done.
5. Payment
You pay the full amount when you place the order. We start production after we have received your payment.
6. Delivery
We tell you the expected production and delivery time in the quote and in the order confirmation. Delivery times are estimates. If we are more than 30 days late, you can cancel the order in writing and we refund what you paid. The risk passes to you when the package is delivered to the address you gave us. We are not liable for delays caused by events outside our control, such as carrier delays, power cuts or shortages of materials.
7. Checking your order and faults
Please check the items when they arrive. Report damage or faults within 14 days of delivery by email to info@mistyprints.com, with photos. A fault you could not see on delivery must be reported within 14 days of finding it. If an item is faulty, we repair or replace it, or refund the price of that item. How returns work is set out in our Returns and Faults policy.
8. Returns
Personalized items are made only for you, so we cannot take them back unless they are faulty. If we agree to take back an item that is not faulty, you pay the return shipping.
9. Safety
Some products contain small magnets. Keep them away from children. If magnets are swallowed they can stick together inside the body and cause serious injury; seek medical help immediately. Do not expose the product to open flame or high heat; 3D-printed plastic can deform or melt. The glass jar in the version with jar can break if dropped; do not use a damaged jar.
10. Your logo and designs
When you send us a logo or text to engrave, you confirm that you have the right to use it, and you hold us harmless against claims from third parties about it. We may refuse designs that infringe someone else's rights or that we consider unlawful or offensive. We use your logo only to make your order, unless you agree in writing that we may show it as an example of our work.
11. Liability
Our liability is limited to the amount paid for the order concerned. We are not liable for indirect loss, such as lost profit or lost sales. These limits do not apply in case of intent or gross negligence on our part.
12. Intellectual property
Our designs, 3D models, renders, logo and texts belong to Mistyprints and may not be copied without permission.
13. Complaints
Email complaints to info@mistyprints.com. We reply within 14 days.
14. Applicable law and language
Dutch law applies. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Disputes go to the competent court in Amsterdam.
These terms are also available in Italian. If the versions differ, the English version prevails.
